Man charged with indecent exposure representing self in court


A 43-year-old man suspected of multiple counts of indecent exposure made the unusual move of representing himself Friday in District Court.

Evan Curtis Johnson, who travels between Durango and Pagosa Springs, said the Durango woman and two Fort Lewis College students accusing him of masturbating in public within a couple feet of them are lying.

He is defending himself against three counts of indecent exposure; each is a felony. Johnson has at least two other convictions for indecent exposure. He is also charged with theft, a misdemeanor.

A preliminary hearing was held Friday to determine whether there is enough evidence to show a crime was committed and that Johnson is connected to it. District Judge David Dickinson found sufficient evidence in all three cases.

His next court hearing is set for 8 a.m. Jan. 30.

Johnson was given the opportunity to cross-examine all three women accusing him of indecent exposure.

The alleged incidents, each separate, took place Dec. 2 and Dec. 3 at FLC and at the First United Methodist Thrift Shop at 986 East Second Ave.

The women each describe similar incidents: a man crowding their personal space, then exposing his genitals and masturbating.

They each had similar reactions as well.

One woman said, “I was shocked. I kind of felt sick to my stomach.”

Another woman said, “It shocked me. I wasn’t sure what I saw, but it was pretty clear that’s what it was. I was kind of angry, too.”

The third woman said, “I was absolutely disgusted, and I was angry, of course.”

Johnson repeatedly used the victims’ names, and he asked them if they were lying or knew the penalty for perjury.

Deputy District Attorney Michael Foote objected to those questions, and Dickinson sustained the objection each time. Dickinson threatened to hold Johnson in contempt of court at least twice.

Johnson appeared to have at least some knowledge about criminal proceedings. He objected on several occasions, and Dickinson ruled in Johnson’s favor on some of them. He also asked series of questions that lawyers would typically ask, but might be unusual for a member of the general public. Questions included: Have you ever seen me before? Was there anyone else in the store? Did anyone else see what you describe? What was I wearing? Did I have any items with me at the time? Were there any other brown-skinned people there?

Throughout the proceeding, Johnson seemed baffled that the women were accusing him of such crimes.

He asked one woman if she hears voices.

Foote objected. Dickinson sustained.

At the end of the hearing, Dickinson strongly advised Johnson to find a lawyer because he has an “appalling” lack of understanding of court proceedings. (At the beginning of the hearing, Johnson had to ask what the purpose of a preliminary hearing was.)

Mark Akehurst, 46, of Wayside Drive in Edenbridge, Kent, flashed at girls aged from seven to 19 in parks and alleys, Lewes Crown Court heard.
